Learning objectives

The educational objectives include:

- consolidate and strengthen the ability to learn and express technical concepts in English

- gain basic knowledge of dispute resolution methods

- develop critical skills regarding the comparative assessment of the best dispute resolution methods to be used

- consolidate and develop the ability to reason and hold a discussion in English.

Contents (summary)

The course aims to provide the student with a general overview of dispute resolution methods. Among these, the following will be considered in particular: the judicial process, arbitration, mediation and negotiation. Specific attention will be dedicated to ADR online.

The teaching will rely on a comparative approach to civil procedure and litigation and will consider the main features of civil law and common law systems as well as, and in parallel, inquisitorial and adversarial procedural models. The role of the judges, the legal professions, the structure and function of Supreme Courts, the problems of access to justice and litigation costs will all be topics and features to be analyzed in this perspective.

The matters of the harmonization of civil procedure systems and transnational litigation will be taken into account.

The study of the single methods of dispute resolution will enable the students to reflect on the scopes of civil procedure and the role of litigation within democratic systems.

Recommended course materials: There is no "textbook". Essays and articles will be suggested during the lectures. Attendance is highly recommended. However, non-attending students are invited to send an email to the professor for recommended readings.

Teaching methods: Classic frontal lectures, work and group discussions

Evaluation methods: The evaluation of the student will take place both during the course and will take into consideration the ability and initiative in participating in the classroom work and group discussions, and by means of the final oral exam.
